1. About these terms

These Terms & Conditions apply when you use boostvits.com (the “Site”) or buy products from www.boostvits.com, trading as BoostVits (“BoostVits”, “we”, “us” or “our”). Please read them before placing an order.

Nothing in these terms limits rights that cannot lawfully be limited, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Our business details

Legal name: www.boostvits.com

Trading name: BoostVits

Email: sales@ashlux.co.uk

3. Who may order

You must have legal capacity to enter into a contract and must provide accurate, current and complete information. Products are supplied for personal or household use unless we agree otherwise in writing. If a product label states that it is unsuitable for a particular age group or person, you must follow that label.

4. Product information and responsible use

We take reasonable care to describe and display products accurately. Packaging, colours and appearance may vary slightly from images, and manufacturers may update packaging or non-material presentation. The product received will be governed by its current label and description.

Food supplements are not a substitute for a varied, balanced diet and healthy lifestyle. They are not medicines and are not intended to diagnose, treat, cure or prevent disease. Always read and follow the label, do not exceed the stated recommended daily amount, and keep products out of the reach of young children.

If you are pregnant, breastfeeding, taking medication, have a medical condition, are under medical supervision, or are unsure whether a product is suitable, seek advice from an appropriately qualified healthcare professional before use. Stop use and seek advice if you experience an adverse reaction.

Information on the Site is general information and is not personalised medical advice. Individual experiences vary, and we do not promise a particular health, fitness, energy, focus, relaxation or sleep outcome.

5. How the order contract is formed

When you place an order, you make an offer to buy the items in your basket.

We will send an acknowledgement confirming that we received the order. An acknowledgement does not by itself mean that we accepted it.

The contract is formed when we send a dispatch confirmation, unless we expressly state another point of acceptance.

If we cannot accept an order, we will tell you and refund any payment taken. Reasons may include unavailable stock, an obvious pricing or description error, inability to authorise payment, suspected fraud, delivery restrictions or order limits.

Please check the order confirmation and tell us promptly if anything is incorrect.

6. Prices, taxes and payment

Prices are shown in pounds sterling and include VAT where applicable. Delivery charges and any other mandatory costs will be shown before you submit the order. You must pay using a method offered at checkout.

We try to ensure prices are accurate. If there is an obvious error, we may contact you for instructions or cancel the affected item and refund payment. We will not be required to supply an item at an obviously incorrect price where the error could reasonably have been recognised.

7. Discount codes and promotions

Promotions may have separate terms. Unless stated otherwise, discount codes cannot be exchanged for cash, combined with another code, applied retrospectively or used after expiry. We may refuse or withdraw a promotion where it is used fraudulently or contrary to its stated terms. Any restriction will not affect an order contract already accepted unless the order involved fraud or an obvious error.

8. Delivery

Delivery destinations, charges and estimates are set out in our Shipping Policy and at checkout. Unless a different timeframe is agreed, we will deliver without undue delay and within 30 days after the contract is formed.

Goods remain at our risk until they come into your physical possession or the possession of a person you identified to receive them. If you choose a carrier that we did not offer, risk may pass when we hand the goods to that carrier, as permitted by law.

9. Ownership

You own the products once we have received payment in full and the products have been delivered, subject to any rights we or you may have following cancellation, rejection or refund.

10. Cancelling, returning and refunding an order

Your statutory cancellation rights, the rules for faulty or misdescribed products and our additional 365-Day Satisfaction Guarantee are explained in the Returns & Refunds Policy. That policy forms part of these terms.

11. Faulty, damaged or misdescribed products

We are under a legal duty to supply products that conform to the contract, including that they are as described, of satisfactory quality and fit for a purpose made known to us where the law applies. Contact us promptly if you believe a product is faulty, damaged, unsafe, incorrect or misdescribed. Your legal remedies may include refund, repair or replacement, depending on the circumstances and timing.

12. Product safety, recalls and adverse events

Do not use a product if its safety seal is missing or damaged when delivered, if the product appears contaminated, or if it is subject to a recall. Keep the product, packaging and batch information and contact us promptly at sales@ashlux.co.uk . Where appropriate, seek medical advice. We may ask for photographs or batch details so that we can investigate and meet product-safety obligations.

13. Accounts

You are responsible for keeping account credentials confidential and for activity carried out through your account, unless caused by our failure to use reasonable security. Tell us promptly if you suspect unauthorised access. We may suspend an account where reasonably necessary for security, fraud prevention, legal compliance or serious misuse.

14. Acceptable use of the Site

You must not use the Site unlawfully; attempt to gain unauthorised access; introduce malware; scrape or overload the Site in a way that disrupts it; impersonate another person; submit false reviews; or use content in a way that infringes another person’s rights.

15. Intellectual property

The Site and its content, including branding, text, graphics, photographs, video, layout and software, are owned by or licensed to us and protected by intellectual-property law. You may view and use the Site for personal, non-commercial purposes. No other licence is granted without written permission.

16. Reviews and other submitted content

If you submit a review, image or other content, you confirm that it is truthful, lawful, relevant, your own or properly licensed, and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting BoostVits, subject to applicable privacy law. We may moderate or remove content that breaches these standards, but we are not required to publish every submission.

17. Third-party links and services

The Site may link to services operated by others. We do not control their content or availability and are not responsible for their acts or omissions, except where the law provides otherwise. Separate terms and privacy notices may apply.

18. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was formed.

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products under applicable law, or breach of your statutory consumer rights.

Products and the Site are supplied for private use. If you use them for a commercial or resale purpose without our agreement, we are not liable for business losses such as loss of profit, revenue, business, opportunity or goodwill, except where liability cannot lawfully be excluded.

19. Events outside reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control, but this does not remove rights you have under consumer law. We will take reasonable steps to reduce the effect, keep you informed and, where performance is materially delayed, allow you to exercise any cancellation or refund rights available by law.

20. Personal information

We handle personal information as described in our Privacy Policy.

21. Changes to these terms

We may update these terms for future use of the Site and future orders. The terms applying to an accepted order are those provided or made available when you ordered, unless a change is required by law or you agree to it.

22. Severability and enforcement

If a court finds part of these terms unlawful, the remaining parts will continue to apply. If we delay enforcing a right, that does not waive it. Only you and we may enforce the contract, except where the law expressly gives rights to another person.

23. Governing law and courts

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also rely on mandatory local consumer protections and bring proceedings in the courts where you live. Otherwise, the courts of England and Wales will have jurisdiction, subject to applicable consumer law.

24. Complaints and contact

If you have a complaint, contact sales@ashlux.co.uk. Please provide your name, order number and a clear description of the issue. We will acknowledge and investigate the complaint within a reasonable time.
